Welcome to Hiliree, a family tree social app that connects users with their family members across the globe. By using Hiliree’s services, you agree to be bound by these Terms of Service (the “Terms”). Please read them carefully as they contain important information about your rights, obligations, and legal remedies.

By accessing or using Hiliree (the “Service”), you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you should not use the Service.

  1. Introduction

Hiliree allows users to create family trees, communicate with family members, make financial contributions to projects, and participate in other family-oriented features, including chat, voice, and video calling.

These Terms apply to all visitors, users, and others who access or use the Service.

  1. Definitions
  • “User” refers to any individual who uses or accesses the Service.
  • “Content” refers to all data, text, software, music, sound, photographs, graphics, video, messages, or other materials made available through Hiliree by users or the company.
  • “We,” “Us,” or “Our” refers to Hiliree and its affiliates, subsidiaries, officers, directors, employees, and agents.
  • “You” or “Your” refers to the individual accessing or using the Service.
  1. Eligibility

You must be at least 13 years old to use the Service or meet the minimum age of consent in your jurisdiction if higher. If you are under 18, you must have your parent or legal guardian’s consent to use the Service.

By accessing or using the Service, you represent and warrant that you meet the legal age requirements and that you comply with all applicable local, state, national, and international laws and regulations.

  1. User Accounts

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account login information, including your password. You agree not to disclose your login credentials to any third party.

Hiliree reserves the right to suspend or terminate accounts if inaccurate, false, or incomplete information is provided, or if these Terms are violated.

  1. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information when you use the Service. The Privacy Policy is part of these Terms.

  1. Third-Party Services and Licenses

Hiliree integrates several third-party services and tools to provide key features. By using the Service, you acknowledge and agree to the use of these third-party services and their respective terms of service. These services include, but are not limited to:

6.1 GetStream (Chat, Voice, and Video Calling)

  • Purpose: Hiliree uses GetStream to enable real-time chat, voice, and video calling features.
  • License: Your use of chat, voice, and video features is subject to the GetStream Terms of Service.

6.2 MongoDB (Database)

  • Purpose: Hiliree uses MongoDB as its database management system to securely store family tree data and other user information.
  • License: MongoDB is governed by the Server-Side Public License (SSPL).

6.3 Amazon Web Services (AWS)

  • Purpose: Hiliree uses AWS for cloud hosting and data storage.
  • License: AWS services are governed by the AWS Customer Agreement.

6.4 Stripe (International Payment Processing)

  • Purpose: Stripe is used for international payment processing within Hiliree, allowing secure transactions for contributions and projects.
  • License: Payments processed through Stripe are subject to the Stripe Services Agreement.

6.5 Paystack (African Payment Processing)

  • Purpose: Hiliree uses Paystack for payment processing in Africa.
  • License: Transactions using Paystack are governed by the Paystack Terms of Service.

6.6 Google Play Store and Apple App Store

  • Purpose: Hiliree is available on both Google Play Store (for Android users) and Apple App Store (for iOS users).
  • License: Use of Hiliree on these platforms is subject to the Google Play Developer Distribution Agreement and Apple Developer Program License Agreement.

You acknowledge that these third-party services may use cookies, store data, and process personal information, as described in their respective privacy policies.

  1. User Responsibilities

By using Hiliree, you agree to the following responsibilities:

  • Comply with Laws: You will use the Service in compliance with all applicable laws and regulations.
  • Provide Accurate Information: You will provide accurate, complete, and current information in your account and family tree.
  • Respect Privacy: You agree to respect the privacy of other users and not share personal information without proper consent.
  • Prohibited Conduct: You will not use the Service to upload, post, or distribute content that is unlawful, offensive, harmful, defamatory, harassing, or otherwise objectionable.

Hiliree reserves the right to remove any content or terminate any accounts that violate these guidelines or applicable laws.

  1. Content Ownership and License

You retain ownership of any content (such as family tree data, messages, photos) you post or share within Hiliree. By posting content on Hiliree, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, and display the content as needed to provide the Service.

You represent and warrant that you own or have permission to share the content, and that posting such content does not infringe on the rights of third parties.

  1. Payment and Financial Contributions

Users may engage in financial contributions for family projects and events. Stripe (for international payments) and Paystack (for payments in Africa) facilitate these transactions. While Hiliree facilitates the process, we are not responsible for managing funds or ensuring the correct use of contributions.

All transactions are subject to the third-party payment processor’s terms and conditions.

  1. Termination of Service

Hiliree reserves the right to terminate or suspend your access to the Service at any time, without notice, for any reason, including but not limited to violations of these Terms or illegal activities.

You may terminate your account at any time by following the instructions in the Settings section of the app. Termination of your account will result in the permanent removal of your data from our servers, except as required by law.

  1. Disclaimer of Warranties

The Service is provided “as-is” and “as available,” without any warranties of any kind, either express or implied. Hiliree disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Hiliree does not warrant that the Service will be uninterrupted, error-free, or completely secure.

  1. Limitation of Liability

To the fullest extent permitted by law, Hiliree will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of your use of or inability to use the Service.

In jurisdictions where limitations of liability for consequential or incidental damages are not allowed, Hiliree’s liability will be limited to the fullest extent permitted by applicable law.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Hiliree, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.

  1. Dispute Resolution

Governing Law: These Terms will be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of law principles.

Arbitration: Any disputes arising out of or relating to these Terms, or your use of the Service will be resolved through binding arbitration in accordance with the rules of the New Jersey State Board of Mediation. Arbitration shall take place in New Jersey.

Class Action Waiver: You agree to resolve any disputes with Hiliree on an individual basis and waive your right to participate in a class or collective action.

  1. Changes to the Terms

Hiliree reserves the right to modify or update these Terms at any time. If we make material changes, we will notify you by updating the “Last Updated” date above and providing a notice within the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

  1. Miscellaneous
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Failure by Hiliree to enforce any right or provision in these Terms will not constitute a waiver of such right or provision.
  • Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and Hiliree regarding the use of the Service.
